Having to deal with an estate is a very complicated and stressful experience. I was very upset to learn that a solicitor would want 5 or 6 thousand pounds to complete this process. Like many, dealing with my late mother`s estate was my first experience of acting as an executor. In my case, my mother`s solicitor was also down as an executor which I think will be fairly common for a lot of people. On informing the solicitor (who also happens to be mine and with whom I have a good relationship) of my mother`s death, he sent me a pack which amongst other things included an estimate of the costs if he did the probate. I have heard too many stories about people being horrified at the cost of this and in my case I worked it out that I would be paying out between £8000 and £10000. At this point, because of the information from the solicitor I realised that doing the work myself could be an option. Again, I have heard of people trying to go alone applying to their Sheriff Court for probate and having it rejected multiple times. The problem is that they won`t tell you where you went wrong as they hide behind the excuse that they are not qualified to give advice ( but it seems they are qualified enough to reject an application). I liken it to playing a game where only one side knows the rules. You will need to get a letter of declinature from a solicitor who is down as an executor which means they they then have no part in the process. Don`t be embarassed by this. It happens all the time and they can`t refuse.
I did a bit of digging and came across My Probate Partner and decided to phone Mike for advice. From my first call, he gave me the confidence to carry on with this myself and so, I signed up with him. I felt fully supported at every step of the way and today at the first attempt, I received the confirmation from the relevant Sheriff Court.
A couple of points to ponder. If you think that by simply giving a solicitor the go ahead with a probate you can sit back and relax and just wait for the cheque to come rolling in, you are mistaken. After all, where is the solicitor going to get all the information about bank accounts held, shares, investments or whatever from ? The answer is you. All they do is collate the information and put it into an acceptable order for the Court and for this, be prepared for a big chunk of any inheritance to disappear into their coffers.
Don`t be afraid, you can do this.

This is an invaluable service provided by Mike Davis. My wife died recently without a will. Several bank bonds she left needed Confirmation from the court before the cash could be recovered. Previously, when my parents died, I simply handed everything over to a solicitor so I was aware of how expensive a process that can be. The process of applying for confirmation is daunting and My Probate Partner checked my application and suggested alterations where things weren't quite right. The easy to use guides helped with docquetting wills and provided a step by step guide to all I needed to complete the process. I was a bit dubious about My Probate Partner – partly because the process in Scotland is Confirmation not Probate. However, reading further it was clear that this was designed around the Scottish Confirmation process. The reviews were good. A solicitor had quoted £3,000 to complete the confirmation form if we, as executors, gathered all the relevant data. The equivalent from MPP was a shade under £600.
We decided to try MPP and am delighted that we did. The web based guides were excellent and the detailed step by step instructions for filling out the form could not have been clearer. The wording on the form being completed is both tricky and critical to get right (not to mention feeling a touch archaic). All of that was dealt with in detail. Once the form was completed MPP reviewed and made a couple of changes and supplied a draft covering letter for the court and some text that has to be written on the original will. I dropped all this in to Dundee Sheriff Court and three weeks later got the call for payment – confirmation had been granted at the first attempt.
I would highly recommend the service being provided. It’s clear, accurate and, given the alternative quote, excellent value for money. I am also confident that we would not have been able to complete this process successfully without some form of assistance.

Key to the MyProbatePartner service is their documentation that guides you through the completion of the C1 form, and then they check your form. With their documentation I was able to complete the C1 with ease including all the necessary legal language which was unfamiliar to me. The team then checked my C1 and corrected a couple of errors I had made - without this check I believe my application may have failed. They also provided guidance about submitting the form to the court and what to do after confirmation was granted. A week after submitting the C1 I was granted confirmation. What a relief!
