Good Afternoon,
As part of the auction registration process, all prospective buyers are required to confirm their agreement to the General Conditions of Sale. In addition, when a buyer clicks on the Legal Pack button on the property listing page, they are presented with two downloadable documents, titled ‘important information when bidding at auction’ and ‘Auction information’ one of which clearly explains that buying at auction constitutes a legally binding contractual commitment. Under the General Conditions of Sale, failure by the successful bidder to pay the required deposit and administration fee constitutes a breach of contract.
As auctioneers, we take every reasonable step to ensure that buyers have access to all material information prior to bidding. This begins at registration, continues through the provision of the legal pack, and is reinforced on every lot page.
We will continue to find ways to provide clear guidance and information, but it remains the buyer’s responsibility to ensure they fully understand their obligations before placing a bid.
