stay clear , item was out of stock ! i’ve recieved no refund even tho ive asked numerous times , to be ignored over and over again company’s a joke

Update - I’ve just been informed that I’ll be getting a refund so thank you Modactive for doing the right thing.

I ordered a t shirt which was in the sale at a reasonable price. However when it arrived, I found that it was shorter than expected and therefore unsuitable. Within one week of delivery, I contacted the company by email to request a return and refund.

I was informed that because the item was purchased in a sale, their policy allowed only an exchange or credit note. I responded to clarify that, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers are entitled to cancel an online purchase within 14 days of receiving the goods and obtain a refund to the original method of payment. This statutory right applies regardless of whether the item was purchased at full price or on sale, and a credit note or exchange does not satisfy the legal requirement following a valid cancellation.

The company reiterated that its internal returns policy did not permit refunds for sale items. I subsequently advised them that this position is inconsistent with consumer protection legislation and again requested a refund. That correspondence was sent over a week ago, and I have since received no further response, nor has any refund been issued.

In light of this, I intend to pursue a chargeback through my bank and to raise a formal complaint with Financial Ombudsman.. While the amount involved is relatively small, I am currently out of pocket and disappointed by the company’s failure to comply with statutory consumer rights. I would therefore not recommend purchasing from this retailer, particularly if there is a possibility that the item may need to be returned.

I wonder how many other customers, who aren’t aware of their statutory rights in this situation, have just accepted the company’s stance at face value and are also out of pocket.

Love these gym sets they are so flattering and such gorgeous colours and the quality is unmatched!! Really recommend!! Xx

The quality is unreal, really stretchy and thick material. Sizing wise I would size up in the pants if you are more shapely as it is not sized to wider hips etc. Will defo be ordering again in every colour🤎

Order some sale items, sent me the incorrect size which i had to pay shipping on to send back, I then exchanged for a non sale item which again was sent to me with the incorrect size. Explained to them i am very unhappy with their services which they could not care about just kept offering me an exchange for the item, which i am now left out of pocket for. Awful customer service from this brand they clearly only care about sales and not their mistakes and customers

Following on from delayed delivery, I have received the set today (Under Armour) and it is a completely different colour set to what was ordered. From what I can gather, the company order from the Under Armour website and you end up getting any colour in stock and not what you order. In my opinion, better and cheaper to order directly from Under Armour.
I’ve raised the issue via my payment method whilst ModaActive respond and provide a solution.

Finally after weeks of being fobbed off over and over the gym set I ordered arrived. It was a completely different set!! Different colours didn't match and the material is so cheap!! If you don't want to be disappointed do not waste you're time buying from this scam of a site!
